{"id":101732,"date":"2024-12-11T09:22:54","date_gmt":"2024-12-11T07:22:54","guid":{"rendered":"https:\/\/www.africa-press.net\/zimbabwe\/all-news\/magistrate-postpones-ruling-on-activists-case"},"modified":"2024-12-11T11:25:17","modified_gmt":"2024-12-11T09:25:17","slug":"magistrate-postpones-ruling-on-activists-case","status":"publish","type":"post","link":"https:\/\/www.africa-press.cc\/zimbabwe\/all-news\/magistrate-postpones-ruling-on-activists-case","title":{"rendered":"Magistrate postpones ruling on activists\u2019 case"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Zimbabwe. <\/strong><\/span>HARARE magistrate yesterday postponed a case in which three human right\u2019s activists want charges against them dropped citing lack of evidence.<\/p>\n<p>Harare magistrate Rufaro Panavanhu yesterday postponed the case after it emerged that the State had not responded to the application for exemption by the activists.<\/p>\n<p>Activists Namatai Kwekweza, Robson Chere and Samuel Gwenzi face allegations of protesting outside the Harare Magistrates Court against the continued detention of dozens of opposition members.<\/p>\n<p>Through their defence lawyers Jeremiah Bamu and Tinashe Chinopfukutwa, the activists submitted that the State had no solid case.<\/p>\n<p>They argued that the accused persons were not present at the time the offence was committed.<\/p>\n<p>The defence argued that this is a crucial aspect of the case, as it challenges the prosecution&#8217;s ability to establish guilt beyond a reasonable doubt.<\/p>\n<p>The trio claimed that it was held incommunicado and tortured for several hours following its dramatic arrest at the Robert Gabriel Mugabe International Airport in July this year.<\/p>\n<p>It was released on September 4.<\/p>\n<p>The matter was remanded to December 18 for ruling on the application of exemption.<\/p>\n<p>Panavanhu previously ruled that the activists can approach the investigating officer who arrested them to collect their gadgets which include cellphones.<\/p>\n<p>Kwekweza recently failed to replace her national identification document (ID) at the Civil Registry Department following her inclusion on the government\u2019s \u201cStop List\u201d in 2020.<\/p>\n<p>A Stop List contains names of people deprived of particular rights, privileges or services or with whom members of an association are forbidden to do business.<\/p>\n<p><strong>For More News And Analysis About <span style=\"color: #ff6600\">Zimbabwe<\/span> Follow <span style=\"color: #ff6600\">Africa-Press<\/span><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Africa-Press &#8211; Zimbabwe.
