Africa-Press<\/a> – Zimbabwe<\/a>. <\/strong><\/span>Nelson Chamisa\u2019s lawyer, Advocate Thabani Mpofu has tweeted suggesting that the latest statement by Professor Lovemore Madhuku was not making sense legally.<\/p>\n

He tweeted after the law expert, Madhuku had given his views on whether or not President Emmerson Mnangagwa breached the Constitution by not announcing that Kembo Mohadi had resigned from the office of the Vice President.<\/p>\n

Guidelines to the resignation of Vice Presidents are in section 96(2) of the Zimbabwean Constitution. It states that the president has to announce the resignation within 24 hours.<\/p>\n

Madhuku had argued that section 96(2) of the Constitution does not apply to the current Vice-Presidents adding that the section will only apply to Vice-Presidents after the coming into force of the running mate clause.<\/p>\n

In response, Mpofu said Madhuku\u2019s submission did not make sense at law and promised to issue a detailed response. He said:<\/p>\n

I have read Professor Madhuku\u2019s latest offering. His views are not sound at law. I will do a brief response and show why. Till then, Varashiki calm down.<\/p>\n

Some say Professor Madhuku was merely protecting the President hence an enabler to the administration led by President Mnangagwa.<\/p>\n

Madhuku\u2019s view was also opposed by Dr. Alex Tawanda Magaisa, a law lecturer based in the United Kingdom who is also a former Chief of staff in the office of the later ex-Prime Minister, Morgan Tsvangirai.<\/p>\n

Magaisa concluded in his recent Big Saturday Read that the argument that it does not apply to the current Vice Presidents, therefore, promptly falls away.<\/p>\n

To that conclusion, Madhuku responded saying he found Magaisa\u2019s article was \u201cshallow and simplistic,\u201d unless it was meant for Twitter.<\/p>\n

Madhuku, Mpofu, and the UK-based Magaisa are some of the most respected legal minds in the land.<\/p>\n
