{"id":36448,"date":"2021-03-12T19:40:23","date_gmt":"2021-03-12T17:40:23","guid":{"rendered":"https:\/\/www.africa-press.net\/zimbabwe\/?p=36448"},"modified":"2021-03-12T19:24:53","modified_gmt":"2021-03-12T17:24:53","slug":"eviction-of-chilonga-people-violates-international-law-human-rights-watch","status":"publish","type":"post","link":"https:\/\/www.africa-press.cc\/zimbabwe\/all-news\/eviction-of-chilonga-people-violates-international-law-human-rights-watch","title":{"rendered":"Eviction Of Chilonga People Violates International Law -Human Rights Watch"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong><a href=\"https:\/\/www.africa-press.net\/\">Africa-Press<\/a> &#8211; <a href=\"https:\/\/www.africa-press.net\/zimbabwe\">Zimbabwe<\/a>. <\/strong><\/span>The Human Rights Watch (HRM) has said Zimbabwe\u2019s planned eviction of Chilonga people in Chiredzi violates the principles of international human rights law.<\/p>\n<p>Zimbabwe intends to evict Chilonga people to pave way for Dendairy\u2019s lucerne grass project.<\/p>\n<p>Dewa Mavhinga, the Southern Africa director at the Human Rights Watch said the African Union and members of the Southern African Development Community (Sadc) should pressure Zimbabwe to respect and protect the rights of the Chilonga community in accordance with national and international law. He said:<\/p>\n<p>It is not disputed that under section 10 of the Communal Land Act, the minister responsible for Local Government, Urban and Rural development can set aside communal land for any purpose, after consultation with the local Rural District Council. The Act permits the minister to order evictions under certain limited circumstances, including after providing reasonable notice, and in compliance with the country\u2019s constitution, which in section 74 prohibits eviction in the absence of a court order. This means that in the absence of a court order, the Chilonga eviction would be unlawful.<\/p>\n<p>Forced displacement without compensation, termed as forced evictions, violates international human rights law. The African Union Convention for the Protection and Assistance of Internally Displaced Persons in Africa, which Zimbabwe ratified, requires in article 3(1)(a) that states parties \u201crefrain from, prohibit and prevent arbitrary displacement of populations. That Zimbabwe signed and ratified the African Union Convention for the protection and assistance of internally displaced people should stop the Zanu PF government from pushing the people of Chilonga into arbitrary relocation.<\/p>\n<p>The African Commission on Human and Peoples\u2019 Rights has stated that the right to property includes the recognition of communities\u2019 traditional and collective ownership of land and their protection from forced evictions.<\/p>\n<p>In General Comment 7, the UN Committee on Economic, Cultural, and Social Rights defines forced evictions as \u201cthe permanent or temporary removal against their will of individuals, families and\/or communities from the homes and\/or land which they occupy, without the provision of, and access to, appropriate forms of legal or other protection.\u201d<\/p>\n<p>Mavhinga added that the committee also urged governments to adequately compensate victims and ensure that \u201cprior to any evictions, particularly those involving large groups, all feasible alternatives are explored in consultation with affected people, with a view to avoiding, or at least minimizing, the use of force.\u201d<\/p>\n<p><b>More: Dewa Mavhinga HRW<\/b><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Africa-Press &#8211; Zimbabwe.
