Africa-Press – Zimbabwe. <\/strong><\/span>The Bulawayo Division of the High Court has reserved judgement in a case involving CCC and Sengezo Tshabangu posing as its Interim Secretary General seeking spoliation damages from Nelson Chamisa.<\/p>\n

As reported by CITE<\/b>, Tshabangu is suing Chamisa after the party\u2019s office in Bulawayo, named the Gertrude Mthombeni House, was repainted from yellow to blue by youths allegedly aligned with the former CCC leader.<\/p>\n

In its application, CCC claimed Chamisa\u2019s supporters forcibly took \u201ccontrol, occupation and possession\u201d of the building and painted the whole offices and precast wall, which was \u201cunlawful, prejudicial and amounts to spoliation.\u201d<\/p>\n

The case was heard on Thursday before Bulawayo High Court Judge, Justice David Mangota, with Tshabangu represented by Nqobani Sithole and Chamisa represented by Obey Shava.<\/p>\n

In his founding affidavit that accompanied CCC\u2019s application, Tshabangu said following Chamisa\u2019s resignation, there was an expectation to have been a \u201csmooth handover takeover process\u201d and such were being undertaken.\u201d
\nHe said a group of \u201cunknown people\u201d about 25 to 30, who allegedly made it clear that they were sent by Chamisa, forcibly took control of the office.<\/p>\n

However, in his opposing affidavit, Chamisa reiterated that he is not currently part of any political organisation, claiming his image and name have been misappropriated by many people who have no connection to him.<\/p>\n

He stated in his affidavit that he had \u201cabsolutely\u201d nothing to do with the takeover of the offices.<\/p>\n

Chamisa said that if Tshabangu, as the applicant, knew the people who had repainted the CCC party premises, he should sue them.<\/p>\n
