Africa-Press – Zimbabwe. <\/strong><\/span>A Bulawayo-based businessman Mohamed Daka has appeared in court facing charges of trying to seize control of a mine in Matabeleland North\u2019s Umguza district and selling its excavator illegally.<\/p>\n

Daka (47) was charged under Section 113 (1) of the Criminal Law Codification and Reform Act Chapter 9:23 after he allegedly conspired with Dumisani Dube to take over Sheng An Mining, a registered mining company based in Hope Fountain, Umguza.<\/p>\n

According to court documents, Daka conspired with Dube to take over the mine despite knowing that Sheng AN Mining is a separate entity from the defunct Fools Investments.<\/p>\n

On Wednesday, Bulawayo regional magistrate Shingi Mutiro heard that on February 3, 2022, the complainant officially changed its name from Fools Investments to Sheng AN Mining, as recorded by the Registrar of Companies.<\/p>\n

Despite this change, the accused allegedly approached the Master of the High Court in Bulawayo in April 2024 and falsely placed the defunct Fools Investments under corporate rescue.<\/p>\n

Dube was appointed as the corporate rescue practitioner on April 24, 2024.<\/p>\n

On May 2, 2024, Daka, who resides in Bradfield, and Dube allegedly sold an orange excavator, valued at US$281,750, to Simba Dumbura of Mutare for US$150,000.<\/p>\n

The excavator, leased to Sheng AN Mining from Rich Mark Zimbabwe, was intended to be permanently removed from the complainant’s control.<\/p>\n

Police investigations led to the recovery of the stolen excavator on July 10, 2024, in Mutare.<\/p>\n

The excavator is now being used as evidence in the ongoing case.<\/p>\n

Detectives secured acknowledgments of receipt for the cash transaction, with Daka signing as a witness.<\/p>\n

Witness statements confirmed that the excavator did not belong to the now-defunct Fools Investments.<\/p>\n

Daka was released on bail by magistrate Mutiro after meeting the set conditions.<\/p>\n

The bail amount was set at US$500.<\/p>\n

Daka was ordered to remain at the address provided to the court and report to the ZRP’s Vehicle Theft Squad twice a week.<\/p>\n
